User Generated Content Policy

At Nugget, we are constantly trying to help foster growing imaginations. One way we can do that is by spreading the magic and creativity of Nuggets to families far and wide! With your permission, we’d like to share your image(s) with the rest of the Nuggetsphere. We are constantly on the lookout for great images to feature on our website, social media, and other marketing materials, so we want to make sure that the contributor, you, grants us permission. If we repost any of your content, we would include your byline or handle whenever possible.

Please take a moment to read through the following terms and conditions to determine if you are able and willing to grant Nugget your consent. After reading through these terms, please respond back to us with the hashtag #YesNugget to acknowledge that you have read and agree to these terms.

By granting Nugget Comfort LLC (“Nugget”) your consent, you agree to the following:

1. You have reviewed and agree to be bound by our Terms of Use and our Privacy Policy.
2. You represent and warrant that: (a) you own all rights to your Submission and there are no other entities with ownership claims over it; (b) you are at least thirteen (13) years of age; (c) you have all rights necessary for you to grant the licenses granted herein; (d) the Submission does not infringe the intellectual property rights, privacy rights, publicity rights or other legal rights of any third party, including any person featured in your Submission; and (e) you will have full responsibility for your Submission, including its legality, reliability, accuracy, appropriateness and trademark, copyright and other intellectual property ownership.
3. You grant Nugget a non-exclusive, non-revocable, perpetual, sublicensable, transferable right to use and reproduce the Submission for marketing and advertising purposes in any medium, now known or later developed, including without limitation, the internet, social media, email, communications, digital video and display, and any other digital or hard copy format, throughout the world. This license is a perpetual, worldwide, royalty-free and non-exclusive license, meaning Nugget may your Submission from now and at any time in the future, anywhere in the world and you will not be compensated.
4. By sharing the Submission with Nugget, you release, discharge and agree to hold Nugget, and any person acting on Nugget’s behalf, harmless from any liability related in any way to their use of your Submission.
5. You waive any claims to royalties with regards to your Submission and agree that you will not be compensated in any way.
6. You agree that if any provision contained herein is determined to be invalid under any rule of law, then it shall, to that extent alone, be deemed omitted, and the remainder of this Submission Use Agreement shall remain in full force and effect. This Submission Use Agreement shall be governed by the laws of the State of North Carolina.
7. You can always withdraw your consent for any further use of your Submission by contacting us with a request to remove your Submission from our website and social media accounts. Please reach out to us at hq@nuggetcomfort.com and include a link to the Submission you wish to have removed.  To the extent we have the control and ability, we will use reasonable efforts to remove the Submission within ten (10) business days of your request.

 

If you don’t agree to these terms, we completely understand, and no further action is required. We are thrilled to have you in the Nuggetsphere and look forward to seeing any new content you post as well.
