The Nugget Reviews Giveaway promotion (the “Promotion”) is intended for legal residents of the United States only and shall only be construed and evaluated according to U.S. law and applicable state law. Do not enter the Promotion if you are not located in the U.S. or otherwise ineligible in accordance with these Official Rules at the time of entry. The Promotion is sponsored by Nugget Comfort LLC, located at 200 Business Park Drive, Butner, NC 27509.

1. ELIGIBILITY

Open to legal residents of the 50 United States and D.C. who are 18+ years of age at the time of entry (“Entrant(s)”). Employees, directors, managers, officers, members, agents and representatives of Nugget and its affiliates, subsidiaries, and agencies, individuals and companies involved in the design, implementation, administration, and execution of the Promotion (collectively, “Promotion Parties”), and members of their immediate family or persons living in the same household, are NOT eligible to participate in the Promotion. By participating in the Promotion, Entrant represents and warrants to Nugget and Promotion Parties that the Entrant meets all of the foregoing eligibility criteria. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. Void wherever prohibited or restricted by law. For the avoidance of doubt, any references in these Official Rules to Entrants shall also include the Entrants who are deemed Winners.

2. AGREEMENT TO OFFICIAL RULES

By participating in the Promotion, Entrants accept and agree to abide by and be bound by these Official Rules and the decisions of Nugget, which are final and binding in all matters relating to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. HOW TO ENTER

The Promotion begins at 12:01am EST on October 15, 2025, and ends at 11:59pm EST on March 31, 2026 (the “Promotion Period”). The Promotion Period will be divided into the following six (6) entry periods (each, an “Entry Period”), which corresponds to six (6) monthly random drawings, as follows:

Nugget’s computer is the official time-keeping device for the Promotion.

Review Request Email: During the Promotion Period, Nugget will send a review request email to customers asking them to review a product they purchased from www.nuggetcomfort.com. The review form will require Entrants to provide certain information including their name, email address, and a product review. By submitting a completed review form, an Entrant will receive one (1) Promotion entry eligible to win a Prize for the drawing corresponding to the Entry Period in which their entry was received.

Alternate Method of Entry: During the Promotion Period, Entrants can also enter the Promotion without submitting a review by sending an email to hq@nuggetcomfort.com. The subject field of the email must include “Entry for Nugget Reviews Promotion” and the body of the email must include their full name and email address. By submitting this alternative entry form via email as instructed above, an Entrant will receive one (1) Promotion entry eligible to win a Prize for the drawing corresponding to the Entry Period in which their entry was received.

Limit one (1) entry per Entrant during the entire Promotion Period, regardless of method of entry. Non-winning entries for any Entry Period will not roll over into subsequent Entry Periods.

The use of automated entry devices is prohibited, and no mechanically reproduced entries are allowed; all such entries are void. Released Parties (as defined below) are not responsible for late, incomplete, delayed, undelivered, or misdirected entries. All entries become the exclusive property of Nugget and will not be acknowledged or returned. All information submitted by Entrants will be treated according to Nugget’s Privacy Policy available at https://nuggetcomfort.com/pages/privacy-policy.  

Nugget may collect and process Entrants' personal contact information in connection with the Promotion for the purposes of administering and managing the Promotion. This processing is in order to fulfill a contract or take steps linked to a contract (including these Official Rules), and if such processing is not provided, Entrant may not be able to enter into, and Nugget may not be able to fulfill, the contract. Nugget will retain the personal contact information that Entrant provides in connection with the Promotion for a period reasonably necessary for the purpose of administering and managing the Promotion, including prize fulfillment, and may disclose such information in connection with a public list of Winners, or pursuant to any license granted to Nugget by Entrant under these Official Rules. Notwithstanding the foregoing, any reviews and related personal contact information submitted by an Entrant may be maintained on Nugget’s and/or its affiliates’ websites for such period of time as determined by Nugget, in its sole discretion.

By submitting any Entry, including any information, text, images, audio, video and any other content therein, Entrants represent that: (a) the Entry is truthful, original, and does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, and does not violate any applicable federal, state or local laws or ordinances; (b) Entrant owns the rights to use and allow the use of the Entry; (c) Entrant has not copied or in any way taken any of the Entry from any third party; and (d) Entrant understands and agrees that their review and name may appear on Nugget’s website. 

4. GENERAL CONDITIONS

If for any reason the operation or administration of the Promotion is impaired or incapable of running as planned for any reason, including but not limited to; infection by computer virus or bugs; tampering or unauthorized intervention; fraud; technical failures; or any other causes beyond the control of Nugget which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Nugget reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Promotion in whole or in part, at any time, without notice and award the Prizes (defined below) using all non-suspect eligible entries received as of, or after (if applicable) the cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. Nugget reserves the right, at its sole discretion, to disqualify any individual deemed to be tampering or attempting to tamper with the entry process or the operation of the Promotion, or Nugget’s website or any third-party website or mobile application used for the Promotion or Nugget’s website; or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NUGGET RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Failure by Nugget to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of a Winner based on an email address, the winning entry will be declared by the authorized account holder of the email address associated with the registration in question. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of the individual who actually participated in the Promotion cannot be resolved to Nugget’s satisfaction, the affected individual's entry will be deemed ineligible. 

5. RELEASE AND LIMITATIONS OF LIABILITY

By participating in the Promotion, Entrants agree to release and hold harmless Nugget, Promotion Parties, and any other party associated with the development or administration of the Promotion, including any vendors, suppliers, consultants, distributors and advertising, marketing, and promotional agencies, and each of their respective parent(s), subsidiaries, affiliates, and agencies, together with each of their respective officers, directors, members, shareholders, employees, independent contractors, vendors, consultants, representatives, agents, successors and assigns (collectively, the “Released Parties”), from and against any and all liability whatsoever in connection with the Promotion, including without limitation any and all claims, costs, injuries, losses, damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light), or cause of action (collectively, “Claims”) arising out of participation in the Promotion or receipt or use of any Prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Promotion; (c) printing errors; (d) errors in the administration of the Promotion or the processing of entries; or (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Promotion or receipt or use of any Prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for: late, incomplete, or incorrect entries; an Entrant’s failure to receive prize notices due to Entrant’s spam, junk e-mail, or other security settings or for Entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in the Promotion; any human error which may occur in the processing of the entries in the Promotion; or any typographical, technological, or other error in the publishing of the offer, administration of the Promotion, or announcement of the prizes, or any combination thereof, including any injury or damage to Entrant’s or any other person's computer relating to or resulting from participation in the Promotion or downloading any materials in the Promotion. The Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Note, some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you. For residents of New Jersey: nothing herein bars recovery of damages or attorneys’ fees where mandated by statute.

Except as expressly provided above, IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THE PROMOTION OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE.

By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in the Promotion or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of a Prize.  Released Parties are not liable in the event that any portion of the Promotion is cancelled due to an act of God, acts of war or terrorism, weather, fire, strike, riot, pandemic or epidemic, act of public enemies, actions of governmental authorities outside the control of such parties (excepting compliance with applicable codes or regulations), or any other condition beyond their control, and failure of Nugget or the Released Parties to comply with any provision of these Official Rules due to any of the foregoing will not be considered a breach of these Official Rules.

EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY IT. SECTION 1542 READS AS FOLLOWS:  “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

6. DRAWINGS

On or before the 10th day after the end of each Entry Period, Prize winners (each, a “Winner”) will be selected in a random drawing conducted by Sponsor from all eligible entries submitted during the corresponding Entry Period. There will be a total of fifteen (15) unique Winners during the entire Promotion Period. Five (5) Winners will be selected for the October Entry Period. Two (2) Winners will be selected for the November through March Entry Periods. 

The Prize drawings will be conducted by Nugget, whose decisions are final and binding. The potential Winners will be contacted by Nugget via email following the drawing for each Entry Period. Odds of winning a Prize will depend on the total number of eligible entries received at the time of each drawing. NOTE: ENTRIES ARE ONLY ELIGIBLE FOR THE DRAWING CORRESPONDING TO THE ENTRY PERIOD IN WHICH THEIR ENTRY WAS RECEIVED. ENTRIES WILL NOT ROLL OVER INTO SUBSEQUENT ENTRY PERIOD’S DRAWINGS. An Entrant is not a Winner of any prize, even if notified of being a Winner or issued any item of value, unless and until Entrant's eligibility has been, and continues to be verified to the satisfaction of Nugget, and Entrant has complied with all other requirements in these Official Rules, including without limitation, the “Prize” section requirements below.

7. PRIZES

There will be fifteen (15) Prizes available, one for each Winner. Each Prize Winner will receive Nugget promotional credit equal to $250, which can be used to purchase products directly from www.nuggetcomfort.com (the “Prize”) until 12/31/2026. Exclusions apply - see below. Nugget will provide the Winners with information on how to receive and redeem their Prize via email. No cash substitutions will be allowed. No substitution, assignment, or transfer of a Prize is permitted by any Winner, except by Nugget, who reserves the right to substitute a prize of equal or greater value. All other expenses associated with Prize acceptance or usage not specifically mentioned herein are the responsibility of the Winners, and Nugget shall not be responsible or liable for expenses or charges incurred by a Winner in connection with the receipt or use of a Prize. NOTE: The Prize may not be used towards the purchase of any third-party licensed products. The Prize must be redeemed by December 31, 2026.

If a Prize or Prize notification is returned as unclaimed or undeliverable to a potential Winner, or if a potential Winner cannot be reached or does not comply with Prize notification instructions within five (5) business days from the first notification attempt, or if the potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Nugget’s sole discretion, an alternate Winner may be selected for the Prize at issue. Only the number of Prizes set forth in these Official Rules will be awarded. In the event that any error, mistake, failure or discrepancy causes more than the stated number of Prizes as set forth in these Official Rules to be promoted, noticed or claimed, Nugget may award only the stated number of prizes by conducting a random drawing from among all legitimate, unawarded, eligible Prize claims.

By accepting a Prize, the Winners agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of the Prize. The Winners will be responsible for all local, state, and federal taxes, including without limitation, income taxes, associated with the receipt of their Prize.  It is the sole responsibility of the Winner to seek independent counsel regarding personal tax implications. The Winners are solely responsible for all matters relating to the Prize after it is awarded. Nugget is in no way responsible for any cancellations, delays, postponements, diversions, substitutions, theft, misplacement, changes in service or any other act or omission, or result thereof, caused by any third party.

By accepting a Prize, where permitted by law, the Winners grant to the Released Parties and those acting pursuant to the authority of Nugget and the Released Parties (which grant will be confirmed in writing upon Nugget’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time their full name, nickname, social media account name and handle and associated photograph, city, state, likeness, image, and/or portrait, picture, voice, likeness, and/or any statement made by Entrant regarding the Promotion or Nugget for advertising, marketing, trade, or promotional purposes without further compensation or additional consideration, and without review, approval or notification. The Winners also acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize.

8. DISPUTES; CHOICE OF LAW AND FORUM

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants and Nugget in connection with the Promotion shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws. By participating in the Promotion, Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, shall be resolved individually without resort to any form of class action; (b) any judicial proceeding shall take place in a federal or state court within the State of North Carolina; (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event will attorney fees be awarded or recoverable; (d) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profits, other damages, and/or any rights to have damages multiplied or otherwise increased; and (e) Entrant’s remedies are limited to a claim for money damages (if any) and Entrant waives any right to seek injunctive or equitable relief. 

9. SEVERABILITY

The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.

10. SPONSOR

THE PROMOTION IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, INSTAGRAM OR ANY OTHER THIRD PARTY. BY ENTERING THE PROMOTION, YOU AGREE TO RELEASE INSTAGRAM AND ANY OTHER THIRD PARTY FROM ANY POTENTIAL LIABILITY IN CONNECTION WITH YOUR ENTRY AND PARTICIPATION IN THE PROMOTION.

11. PRIVACY

Information submitted with an entry is subject to Nugget’s Privacy Policy, available at www.nuggetcomfort.com/pages/privacy-policy. By participating in the Promotion and providing any personal contact information, Entrants hereby agree to Nugget’s collection and usage of their personal information and acknowledge that they have read and accepted these Official Rules and Nugget’s Privacy Policy. By entering the Sweepstakes, Entrants acknowledge their automatic opt-in to the Nugget’s email database. All subsequent emails from the Nugget will have an unsubscribe/opt-out option.

12. MISCELLANEOUS

These Official Rules contain the full and complete understanding with respect to the Promotion and supersede all prior and contemporaneous agreements, representations and understandings, whether oral, electronic or written. In the event of an inconsistency between these Official Rules and any disclosure or other statement contained in any Promotion-related materials, including without limitation, an entry form or any point-of-sale, radio, television, print, or online advertising, these Official Rules will prevail and govern. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by Nugget. The waiver by Nugget of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Nugget, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Nugget and Entrants.

13. WINNERS LIST

If required by law, a list of the names of all Winners will be available for thirty (30) days following the drawing, which you may request a copy of by sending a request via a self-addressed, stamped #10 envelope to: Nugget Comfort LLC, 200 Business Park Drive, Butner, North Carolina 27509. Requests received after such thirty (30) day period will not be honored. Vermont residents may omit postage.
