Personalization - Embroidered Products

Terms & Conditions

These Terms & Conditions (these “Terms”) apply to any order that includes any personalized embroidery stitching (“Embroidered Product”) purchased from us through our online store at www.nuggetcomfort.com. By placing an order for an Embroidered Product, you agree to these Terms, in addition to our Terms of Sale, Terms of Use, Privacy Policy, and applicable FAQs.  If there is a conflict between these Terms and any of our other terms or marketing content, these Terms control.

Availability: Personalization is available only on select products and is limited by font type, size, number of characters, fabric type/color, seam placement/construction, and production capacity.  Embroidery stitching is a physical process. Product preview is an approximation and some variations in font, text size/placement, and colors may occur. We may refuse or cancel any personalization request in our sole discretion, including for operational reasons or if your request violates our Prohibited Content (see below).  If we cancel an Embroidered Product order before fulfillment, we will refund any amounts paid for the unfulfilled order.

Review and Confirm All Personalization Details: You are responsible for confirming that your personalization details are accurate (including spelling, capitalization, punctuation, spacing, etc.) before placing your order.  Once an order containing personalization is placed, you may not change, edit, or cancel, and the Personalization fee is nonrefundable.

Final Sale - No Returns, Refunds, or Cancellations: All personalization orders are “Final Sale” and not eligible for returns, refunds, cancellations, or exchanges, unless explicitly stated in these Terms.  However, if we make an error or your Embroidered Product arrives with a manufacturing defect or with damage caused during transit, we may, at our option, repair, replace, or re‑make the item.

Personalization fee: We charge a flat fee for each Embroidered Product (“Personalization fee”). The exact amount is reflected on the product page and at checkout.  Unless explicitly stated, the Personalization fee is excluded from any promotional pricing and discounts.  All sales and other applicable taxes apply.

Timing: Embroidered Products require extra production time compared to non‑Embroidered Products. Any delivery dates shown are only estimates.  During high‑volume periods (e.g., holidays), personalization production times may increase.  Orders with both Embroidered Products and non‑Embroidered Products may ship separately.

Personalization Content: You agree not to request personalization that is illegal, hateful, or inappropriate content.  We may refuse or cancel any order that, in our judgment, violates these standards.  You guarantee that you have the rights and permissions to use any text or design you submit.  If you include personal data (like a name) in your order, you understand that we will use that information only to fulfill your order.  You agree to indemnify and hold us harmless from claims arising out of the content you request, including intellectual property infringement claims.

Care: Follow product care instructions. Normal wear and tear can affect embroidery stitching (e.g. fraying/puckering) and are expected outcomes over time.

No Warranty Claims: We do not provide warranties for the personalization components of Embroidered Products. Our standard Limited Warranty for our base products does not cover personalization, including claims based on appearance, durability of stitching, thread wear, or embroidery outcomes. If we make an error or your Embroidered Product arrives with a manufacturing defect or with damage caused during transit, we may, at our option, repair, replace, or re‑make the item. Miscellaneous: Nothing in these Terms limits rights that cannot be excluded under applicable law (including any non‑waivable consumer guarantees).  To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from personalization or Embroidered Products.  Our total liability related to personalization will not exceed the amount you paid for the Embroidered Product at issue.  We may update these Terms from time to time.  The Terms in effect at the time you place your order will apply to that order.  We reserve the right, in our sole discretion, to suspend or terminate Personalization options at any time.  For any questions regarding personalization, please contact hq@nuggetcomfort.com!
